Terms & Conditions

Please read these Terms and Conditions carefully before using www.creasi.co.id operated by PT Kreatif Ideologi. This Agreement sets forth the legally binding terms and conditions for your use of the website at www.creasi.co.id. By accessing or using the website in any manner, including, but not limited to, visiting or browsing the website or contributing content or other materials to the website, you agree to be bound by these Terms and Conditions. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the website or discontinue any use of the website immediately. The products and services provided in the website shall only be available to Creative Talent (users seeking employment) or Talent Seekers (users seeking employees) or other users such as advertisers.

Terminology

The following terms have the follow meanings:

  • You, your and user refer to all individuals accessing this website.
  • We, us and our refer to Creasi (Creative Society Indonesia)

Eligibility and Accounts

To use Creasi, users have to register for an account, provide accurate and complete information, and keep their account information updated. Both Creative Talent (users seeking employment) and Talent Seekers (users seeking employees) undergo the same account registration process. Each account must be a personal account, but users may trade as a sole trader, company or any other legal entity (whether incorporated or unincorporated).

In consideration of your use of this website, you agree to provide true, accurate, current and complete about yourself on our registration form; maintain and update your data to keep it true, accurate, current and complete. We have the right to suspend or terminate your account and refuse any and all current or future use of our service if you provide any information that is untrue, inaccurate, not current or incomplete or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete. We also have the right to restrict your access, temporarily or indefinitely block your account, stop any jobs you have in progress, warn other Creative Talents and Talent Seekers of your actions or issue you a warning On obtaining an account, you'll have access to the services and the functionality that we may establish and maintain at our sole discretion. You agree to use your account for your personal use only and not to redistribute any of the content on this site. Accounts may be obtained and used only by independent professionals who are seeking legal employment or career resources; and/or individuals with the right and authority to act on behalf of an organization for the purposes of locating independent professionals for available positions. Creative Talents can only be contacted for a job opportunity through the website by posting a job through the website. Creative Talents are not allowed to intentionally share personal contacts, such as telephone number, mobile phone number and email in any part of their profile that can be seen by other users.

We expect all of our users to conduct themselves in a courteous, professional manner at all times. Personal attacks, flaming and other forms of discourteous and unprofessional online conduct are grounds, at our discretion, for the immediate suspension or termination of the offending party's account. Actions that may indicate an illegal act can result in an immediate ban from the website and may also include legal actions.

Users are solely responsible for any activity that occurs on their account, unless it is a result of actions beyond their control (such as hacking or if someone steals their password when they have taken reasonable steps to keep it secure). Users may never use another person's user account or registration information for the website.

Although we aim to offer you the best service possible, we make no promise that the services at the creasi.co.id will meet your requirements. We cannot guarantee that the creasi.co.id will be fault-free, error-free, or that creasi.co.id and servers are free of viruses or other harmful mechanisms. If a fault occurs then you should report by contacting us and we will attempt to correct the fault.

Users under 18 years old

It's really important to us that we help protect your child's privacy and safety on Creasi, while also giving them access to relevant castings or interviews. Castings or interviews on the site can be checked by our Customer Support team and we work with parents to ensure minors are looked after. We cannot, however, guarantee and ensure privacy and safety for every user. Each and every user must be responsible for their own privacy and safety in using the services of Creasi.

Members must be aged 18 or over to join Creasi, but a parent or guardian can sign up on their child's behalf and apply to relevant auditions and jobs. To register on behalf of someone who is under 18, please follow the normal registration process. Extra information about the parent/guardian is required during registration, but all details are kept confidential. For safety reasons, please don't include any direct contact information on your child's profile, such as phone numbers or email addresses, or any places where the child may be located (schools, etc.).

User Content

You are solely responsible for your communications and the consequences of their posting and for the content and information you provide, distribute, post, include, link to, or otherwise upload to our site. You also agree that we are only acting as a passive medium or platform for the online distribution and publication of your content. However, although we are not obligated, we reserve the right to take any action with respect to your content if we believe that it may create a liability for us.

Maintaining the integrity of our user base is critical for us. We continuously monitor profiles and projects to ensure that they meet the standards expected for creative professionals. As mentioned above, we reserve the right to take any action necessary with respect to your content if we believe that it detracts from the experience we seek to provide for our audience. We try to ensure all of the users content meet professional standards to benefit both Creative Talents and Talent Seekers, however we do not guarantee the results of Creative Talents receiving a job or Talent Seekers obtaining Creative Talents.

You must not, and by using Creasi you agree not to:

  • Post material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it
  • Post material that reveals trade secrets, unless you own them or have the permission of the owner
  • Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others
  • Post material that is obscene, defamatory, threatening, harassing, abusive, or hateful
  • Post sexually-explicit images or statements
  • Post illegal materials or act illegally
  • Post material that contains viruses or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.
  • Impersonate another person
  • Publish a profile and/or projects for the direct intent of driving traffic to an ecommerce web site without supporting contextual information on why the profile or project is relevant to the Creasi ecosystem.
  • "Stalk" or otherwise harass another; or collect or store personal data about other users
  • Share information that enables other users to contact you directly, such as telephone number, mobile phone number and email. As Creative Talents, this information will only be shared to Talent Seekers who have posted a job you have applied to.

Job Posting

One of our primary services is a creative employment recruiting service, consisting of job postings published directly by Talent Seekers.

You must not, and by using Creasi you agree not to:

  • Post advertisements or solicitations of business, chain letters or pyramid schemes
  • Post advertisements for multiple openings or positions. Each job posting is intended for a single job or project.
  • Post advertisements that point to spec work, contests or other opportunities to solicit customized, unpaid creative work from creative professionals

Whether your posting is for paid or unpaid work, you warrant that your posting and the job or audition advertised are not in breach of any relevant law from time to time in force including, but not limited to, the laws relating to the national minimum wage, employment rights and equality/diversity. You agree that it is your responsibility to meet all legal obligations towards those whom your posting is aimed at.

Any postings violating the terms above may be edited or removed, thus pending or failing Creasi's job moderation process.

Except for the one time free trial job post, all job postings submitted can only be published after:

  • Moderated by Creasi’s Customer Relations team
  • Payment has been confirmed and received by Creasi

The one time free trial job post will be published after being moderated by our Customer Relations Team.

Once your job has been published, you provide the right for Creasi to sort and recommend all applicants to your job post. The sort and recommend by Creasi may be conducted by moving applicant(s) from one folder to another folder in your dashboard. All applicants will remain in your dashboard and will not be removed. If you are not willing to have us sort and/or recommend your applicants, you must notify us within 3 days after your job has been published.

We normally do not provide money refunds for any reason. For certain cases, such as when a payment for a job post has been made but failed the moderation process, Creasi will provide 1 free job post credit.

Intellectual Property

The website and its original content, features and functionality are owned by PT Kreatif Ideologi and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. You should assume that all content, such as text, graphics, images, logos, buttons, icons, trademarks and other material and their compilation (meaning the collection, arrangement and assembly) are the exclusive intellectual property of Creasi and are protected under both Indonesia and foreign copyright, trademark and other laws. The code that Creasi created to generate its pages is also protected by our copyright and shall not be copied or adapted. All reproduction in whole or in part of the texts or illustrations, by any means whatsoever and without prior consent, is prohibited. You may print a single copy of site content for your personal use, but must retain all copyright, trademark, service-mark and other proprietary notices contained in the original material on any copy you make. You may not sell or modify it, or reproduce, display, publicly perform, distribute, or otherwise use it in any way for any public or commercial purpose. Unauthorized use of any of the above may violate copyright, trademark, and other laws.

All users must adhere to the governing law about copyrights as stated in UU No. 19/2002. Creasi.co.id cannot be held responsible for any misuse by users in the context of copyrighted work or portfolio.

Security Rules

Users are prohibited from violating or attempting to violate the security of Creasi, including attempts to:

  • Access data not intended for them or logging into a server or account, which the user is not authorized to access
  • Probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization
  • Interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the site, overloading, flooding, spamming, mail-bombing or crashing
  • Send unsolicited email, including promotions and/or advertising of products or services
  • Forego any TCP/IP packet header or any part of the header information in any email or newsgroup posting
  • Use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this site other than the search engine and search agents available from Creasi and generally available third party web browsers
  • Decipher, disassemble or reverse engineer any of the software comprising or making up any part of this website
  • Aggregate, copy, duplicate, or frame to in any manner any of the materials or information available from Creasi
  • Use any device, software or routine to interfere or attempt to interfere with the proper working of this website or any activity being conducted on it, including any action which imposes an unreasonable or disproportionately large load on the site's infrastructure

Violations of system or network security may result in civil or criminal liability. Creasi will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

Links to Third-Party Websites

Our website may contain links to third-party websites that are not owned or controlled by PT Kreatif Ideologi. PT Kreatif Ideologi has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You understand and agree that we're only acting as a platform and that we have no liability related to the third-party, whether arising under the laws of copyright, libel, privacy or obscenity. We strongly advise you to read the terms and conditions and privacy policy of any third-party website that you visit.

Liability for Third-Party Content

Creasi is only a platform for Talent Seekers to post job opportunities and Creative Talents to create profiles and post portfolios. Creasi is not to be considered a Creative Talent or Talent Seeker with respect to the use of our site and shall not be responsible for any Creative Talents or Talent Seekers decisions, for whatever reason made by any entity posting jobs on our site.

We are not involved in the actual transaction between Talent Seekers and Creative Talents. We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Web site. As a result, we have no control over the quality, safety or legality of the jobs or profiles posted, the truth or accuracy of the listings, the ability of Talent Seekers to offer job opportunities to Creative Talents or the ability of Creative Talents to fill job openings.

We also do not make any warranty, express or implied, regarding any job posting, any individual or organization providing a posting or for any profiles or resumes. You agree that any agreement between you and any individual or organization be based solely on the terms negotiated by them and you and shall be done at your own risk.

Creasi does not represent or guarantee the truthfulness, accuracy or reliability of communications posted by users or endorse any opinions expressed by them. You acknowledge that any reliance on material posted by other users will be at your own risk. Creasi has no obligation to screen communications or information in advance and is not responsible for monitoring material posted by users. We expect that you will use caution and common sense when using this site and your account.

If notified by a user of communications which allegedly do not conform to our conditions of use, we may investigate the allegation and determine in good faith and at our sole discretion whether to remove or request the removal of the communication.

Because user authentication on the Internet is difficult, Creasi cannot and does not confirm that each user is who they claim to be. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. You assume all risks associated with dealing with other users with whom you come in contact through this site; we expect that you will use caution and common sense when using it.

Because we cannot be involved in user-to-user dealings or control the behavior of participants of Creasi in the event that you have a dispute with one or more users, you release us from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Advertising and Sponsorship Policy

Part of the Creasi website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on Creasi website complies with relevant laws and codes. We reserve the right to refuse to run any advertisements that, in creasi.co.id sole discretion, are not suitable for publication on any of the Creasi website. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

Governing Law

This Agreement shall be governed and construed in accordance with the laws of the Republic of Indonesia, without giving effect to any principles of conflicts of law. You are responsible to ensure that you comply to your country's law, regulation and legislation on employment. This includes your responsibility to ensure that you are of legal employment age in your respective country to apply for a job.

Changes to This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the website. Your continued use of the website after any such changes constitutes your acceptance of the new Terms and Conditions. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the website or discontinue any use of the website immediately.
